1. Acceptance of Terms
Welcome to Mexico Trek® (the "Trek," "we," "our," or "us"). Mexico Trek® is a registered trademark in both the United States and Mexico. These Terms of Service ("Terms") govern your access to and use of our website mxtrek.com and your participation in the Mexico Trek 2027 program.
By submitting an application, creating an account, or participating in the Trek, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services or participate in the Trek.
2. Trademark and Intellectual Property
Mexico Trek® is a registered trademark in the United States and Mexico. All content on our website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Mexico Trek or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not use our trademarks, logos, or branding without our express written permission. Unauthorized use may result in legal action.
3. Eligibility and Age Requirements
Minimum Age: You must be at least 18 years old to participate in Mexico Trek. This policy applies to all participants, including significant others and any accompanying individuals.
Reason for Age Policy: The Trek features a dynamic schedule with various activities, some of which may include optional alcohol consumption. The legal age of adulthood in Mexico is 18, and this policy ensures all participants can fully engage in all Trek activities in compliance with local laws.
By applying, you represent and warrant that you meet this age requirement and that all information provided in your application is accurate and complete.
4. Application and Acceptance Process
To participate in the Trek, you must:
- Submit a complete application through mxtrek.com
- Await review by the Organizing Committee
- If accepted, receive an email notification
- Pay a US$600.00 deposit to secure your spot
Acceptance is not guaranteed. The Organizing Committee reserves the right to accept or reject applications at its sole discretion.
5. Pricing and Payment Terms
5.1 Trek Pricing
Thanks to our generous sponsors, every participant receives a subsidy, and subsidies are distributed in batches. The amounts stated below are the final price payable per person — the subsidy has already been deducted and no further amount is owed on top of it:
- US$1,799.00 final price — early-bird spots, after a US$1,000.00 subsidy (to reward early adopters)
- US$1,949.00 final price — following batch, after a US$850.00 subsidy
- US$2,099.00 final price — final batch, after a US$700.00 subsidy
The price applicable to you is the one in effect when your spot is confirmed.
What's Included:
- 8 hotel nights (March 13-20, 2027)
- All meals and beverages during scheduled activities (including alcohol where indicated)
- Domestic flights within Mexico between trip cities
- Ground transportation to all activities
- Unique local experiences and cultural activities
- Day 0 activities (March 13) including visits to Frida Kahlo Museum, Coyoacán Market, and Lucha Libre
- 24/7 staff services during the Trek
- All tips and taxes
What's NOT Included:
- International flights to/from Mexico
- Hotel accommodation for Friday, March 12 (optional pre-Trek arrival)
- Hotel accommodation for Sunday, March 21 (departure day)
- Travel insurance
- Personal expenses and purchases
- Visa fees (if applicable)
5.2 Significant Others and Companions
Significant others are welcome and receive the same subsidy, so they pay the same price per person as any other participant at the batch in effect when the spot is confirmed. You must indicate your intent to bring a significant other in your application.
5.3 Deposit and Payment Schedule
- Deposit: US$600.00 due upon acceptance to secure your spot
- Deposit Terms: Non-refundable but transferable (see Section 6)
- Final Payment: Remaining balance due according to the payment schedule provided upon acceptance
6. Cancellation and Transfer Policy
6.1 Deposit Refund Policy
The US$600.00 deposit is non-refundable under all circumstances, including but not limited to:
- Voluntary cancellation by participant
- Inability to obtain visa or travel documents
- Medical emergencies or personal circumstances
- Travel restrictions or advisories
- Force majeure events
6.2 Spot Transfer Policy
Your spot is transferable until February 1, 2027, subject to the following conditions:
- You may transfer your spot to another eligible person only once
- The transfer recipient cannot transfer the spot again
- No transfers are permitted after February 1, 2027
- The new participant must meet all eligibility requirements (age 18+, complete application)
- The new participant must be approved by the Organizing Committee
- Transfers must be initiated through the dashboard's "Transfer Spot" feature
6.3 Trek Cancellation by Organizers
We reserve the right to cancel or modify the Trek due to circumstances beyond our control, including but not limited to natural disasters, political instability, pandemics, or insufficient enrollment. In such cases, we will provide a full refund of all payments received but are not liable for any other costs or damages.
7. Travel Requirements and Participant Responsibilities
7.1 Visa and Immigration
Visa to Enter Mexico: Foreign visitors with a valid U.S. visa are exempt from needing a Mexican visa when traveling for tourism purposes.
Returning to the U.S.: International students must ensure their I-20 is up to date and bring their passport and I-20 for re-entry to the United States.
Your Responsibility: You are solely responsible for obtaining all necessary travel documents, visas, and permits. We are not responsible for denial of entry or any immigration-related issues.
7.2 Travel Insurance
REQUIRED: All participants must obtain comprehensive travel insurance that includes:
- Medical coverage (including COVID-19)
- Emergency medical evacuation
- Trip cancellation and interruption
- Lost or stolen belongings
You are responsible for purchasing your own insurance. Mexico Trek does not provide insurance coverage and is not liable for any medical, travel, or personal expenses.
7.3 Health and Safety
Dietary Accommodations: We provide vegetarian options at all meals. However, we cannot guarantee vegan options, as not all Mexican restaurants and food providers can accommodate fully vegan dietary requirements.
Medical Conditions: You must disclose any medical conditions, allergies, or dietary restrictions in your logistics form. We will make reasonable efforts to accommodate special needs but cannot guarantee all requests can be fulfilled.
7.4 International Travel
You are responsible for:
- Booking and paying for your international flights to Mexico City (arriving by March 13, 2027)
- Booking and paying for your return flight from Oaxaca City (departing March 21, 2027 or later)
- Arriving on time for the Trek start date
- Any costs associated with flight delays, cancellations, or missed connections
8. Liability Waiver and Assumption of Risk
8.1 Voluntary Participation
BY PARTICIPATING IN MEXICO TREK, YOU ACKNOWLEDGE AND AGREE THAT:
- You are voluntarily participating in the Trek at your own risk
- You assume full responsibility and accountability for your personal safety, belongings, and well-being
- You understand that travel involves inherent risks, including but not limited to:
- Illness, injury, or death
- Lost or stolen property
- Transportation accidents
- Food-borne illnesses
- Natural disasters
- Political instability or civil unrest
- Acts of terrorism
- COVID-19 or other infectious diseases
8.2 Release of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS MEXICO TREK, ITS ORGANIZERS, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, SPONSORS, PARTNERS, SUPPLIERS, AND AFFILIATES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO:
- Personal injury, illness, or death
- Property damage or loss
- Emotional distress
- Economic loss
- Any other damages or losses of any kind
This release applies whether the injury or damage is caused by the negligence of Mexico Trek or its representatives, or otherwise, except where prohibited by law.
8.3 Indemnification
You agree to indemnify, defend, and hold harmless Mexico Trek and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your violation of these Terms
- Your participation in the Trek
- Your negligence or willful misconduct
- Your violation of any law or the rights of a third party
9. Code of Conduct
9.1 Following Organizer Instructions
You agree to follow all instructions and guidance provided by Trek organizers and staff throughout the program. This includes, but is not limited to:
- Adhering to scheduled activities and timelines
- Following safety protocols and emergency procedures
- Respecting venue rules and local customs
- Complying with Mexican laws and regulations
Failure to comply may result in immediate removal from the Trek without refund.
9.2 Prohibited Conduct
The following behaviors are strictly prohibited and may result in immediate dismissal from the Trek:
- Harassment, discrimination, or threatening behavior
- Illegal drug use or excessive alcohol consumption
- Damage to property or facilities
- Disorderly conduct or behavior that endangers yourself or others
- Violation of local laws or customs
- Any conduct that disrupts the Trek experience for other participants
9.3 Right to Remove Participants
We reserve the right to remove any participant from the Trek at any time for violation of these Terms, inappropriate conduct, or any reason that threatens the safety or well-being of participants or staff. No refunds will be provided in such cases.
10. Media Release and Image Rights
By participating in Mexico Trek, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, publish, and distribute your name, image, likeness, biography, voice, and any photos or videos taken during the Trek for the following purposes:
- Promotional materials for future Mexico Trek programs
- Marketing and communications with sponsors, partners, and donors
- Recruitment materials for future participants
- Presentations to speakers, leaders, government officials, and community members
- Website content, social media posts, and digital marketing campaigns
- Print materials, brochures, and annual reports
- Educational content and nonprofit promotional purposes
- Press releases and media coverage
- Internal documentation and historical archives
You will not receive any compensation for the use of your image or likeness. This grant includes the right to edit, alter, or modify the media as needed.
Opt-Out: If you do not wish to be photographed or have your image used, you must notify us in writing at outreach@mxtrek.com before March 1, 2027. Note that opting out may limit your ability to participate in certain group activities and events.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IN NO EVENT SHALL MEXICO TREK OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR PARTICIPATION IN THE TREK.
- OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PARTICIPATION IN THE TREK SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE TREK.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
12. Changes to the Trek Program
We reserve the right to make changes to the Trek itinerary, schedule, activities, speakers, accommodations, or any other aspect of the program at any time due to circumstances beyond our control or for logistical reasons. We will make reasonable efforts to provide comparable alternatives, but we are not liable for any changes or substitutions.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
13.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or your participation in the Trek shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California, and shall be conducted in English.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Modifications to Terms
We may revise these Terms at any time by posting updated Terms on our website. Your continued participation in the Trek after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated via email.

BY SUBMITTING YOUR APPLICATION, CREATING AN ACCOUNT, PAYING YOUR DEPOSIT, OR PARTICIPATING IN MEXICO TREK, YOU ACKNOWLEDGE THAT:
- You have read, understood, and agree to be bound by these Terms of Service
- You have read and agree to our Privacy Policy
- You understand and accept the liability waiver and assumption of risk
- You grant us the right to use your image and likeness for promotional purposes
- You are participating in the Trek at your own risk and expense
- You are responsible for obtaining travel insurance, visas, and all necessary travel documents
- You agree to follow all instructions from Trek organizers and staff
- The deposit is non-refundable but transferable under the conditions stated above
